1. Acceptance of Terms

Welcome to Vetted ("Platform," "we," "our," or "us"). By accessing or using our platform, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and Vetted. Your continued use of the Platform signifies your acceptance of these Terms and any modifications we may make from time to time.

By using our Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Definitions

  • "Platform" refers to the Vetted job board website, mobile applications, and all related services
  • "Job Seeker" refers to any individual seeking employment opportunities through the Platform
  • "Employer" refers to any organization or individual posting job opportunities on the Platform
  • "Content" refers to all text, images, data, information, and materials uploaded, posted, or transmitted through the Platform
  • "Security Clearance" refers to Australian government security clearances including Baseline, NV1, NV2, and PV
  • "Application" refers to a job application submitted by a Job Seeker to an Employer through the Platform

3. User Accounts

3.1 Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

3.2 Account Types

The Platform offers two types of user accounts:

  • Job Seeker Accounts: For individuals seeking cleared employment opportunities
  • Employer Accounts: For organizations posting cleared job opportunities (subject to verification and approval)

3.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms or engaged in conduct that we deem inappropriate or harmful to the Platform or other users.

4. Job Seekers

4.1 Profile Information

As a Job Seeker, you agree to:

  • Provide truthful and accurate information about your qualifications, clearance level, and experience
  • Upload only legitimate, virus-free documents (CVs, resumes, cover letters)
  • Not misrepresent your security clearance level or status
  • Keep your profile information current and accurate

4.2 Job Applications

When applying for jobs through the Platform:

  • You grant Employers access to your application materials for the specific job you applied to
  • You understand that we do not guarantee job placement or interviews
  • You are responsible for all communications with Employers outside the Platform
  • You agree not to apply to jobs you are not qualified for or do not intend to pursue

4.3 Clearance Verification

While we ask for your clearance level, we do not verify clearances. It is your responsibility to ensure you have the required clearance for positions you apply to. Employers may request proof of clearance during their hiring process.

5. Employers

5.1 Employer Verification

All Employer accounts are subject to verification and approval. You agree to:

  • Provide accurate company information and legitimate contact details
  • Represent a genuine organization with legitimate hiring needs
  • Cooperate with our verification process
  • Notify us of any changes to your company information

5.2 Employer Obligations

As an Employer, you agree to:

  • Post only genuine job opportunities requiring security clearances
  • Comply with all applicable employment laws and anti-discrimination regulations
  • Handle applicant information confidentially and professionally
  • Not use the Platform to collect personal information for purposes other than recruitment
  • Respond to applications in a timely and professional manner
  • Not contact Job Seekers who have not applied to your specific jobs

5.3 Fees and Payment

The Platform is currently free for Employers during the MVP phase. We reserve the right to introduce fees in the future, with reasonable notice to existing Employers.

6. Job Postings

6.1 Job Posting Requirements

All job postings must:

  • Be for genuine employment opportunities requiring security clearances
  • Contain accurate information about the role, requirements, and employer
  • Comply with Australian employment and anti-discrimination laws
  • Not contain misleading, false, or fraudulent information
  • Not discriminate based on protected characteristics (except where clearance requirements are legitimate)

6.2 Job Moderation

We review all job postings before they go live. We reserve the right to:

  • Approve, reject, or request modifications to job postings
  • Remove job postings that violate these Terms
  • Edit job postings for clarity or compliance (with Employer notification)

6.3 Job Posting Duration

Job postings remain active until you close them or we remove them for policy violations. You are responsible for closing job postings when positions are filled.

7. Prohibited Conduct

You agree not to:

  • Misrepresent your identity, clearance level, qualifications, or company affiliation
  • Post false, misleading, or fraudulent job listings or applications
  • Use the Platform for any purpose other than legitimate job seeking or recruitment
  • Scrape, harvest, or collect user data without authorization
  • Upload viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Harass, abuse, threaten, or discriminate against other users
  • Violate any applicable laws or regulations
  • Interfere with the proper functioning of the Platform
  • Use automated systems (bots, scrapers) to access the Platform
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Create multiple accounts to circumvent restrictions or bans
  • Share confidential or sensitive security information inappropriately

8. Intellectual Property

8.1 Platform Ownership

The Platform, including all software, code, design, content, trademarks, and materials, is owned by Vetted and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8.2 User Content License

When you upload Content to the Platform (CVs, job postings, profiles), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that Content solely for the purpose of operating the Platform.

You retain ownership of your Content. You can delete your Content at any time by removing it from the Platform or closing your account.

9. Disclaimers

9.1 "As Is" Basis

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Employment Guarantee

We do not guarantee that Job Seekers will find employment or that Employers will find suitable candidates. We are a platform that facilitates connections; we are not an employment agency or recruiter.

9.3 User Content

We do not verify the accuracy of user-provided information, qualifications, clearance levels, or company legitimacy beyond our standard verification process. We are not responsible for false or misleading Content posted by users.

9.4 Third Parties

We are not responsible for the conduct of Employers, Job Seekers, or any third parties using the Platform. Employment relationships are between Employers and Job Seekers; we are not a party to those relationships.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VETTED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Costs of procurement of substitute services
  • Inability to find employment or suitable candidates
  • Damages arising from user interactions or employment relationships

Our total liability to you for all claims arising from your use of the Platform shall not exceed AUD $100 or the amount you paid us in the past 12 months, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Vetted, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you upload or post on the Platform
  • Your interactions with other users
  • Any employment relationships or disputes arising from your use of the Platform

12. Termination

12.1 Termination by You

You may close your account at any time by contacting us at support@vetted.com.au. Upon closure, your profile and content will be removed within 90 days, except where we are required to retain information for legal purposes.

12.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent, abusive, or illegal conduct
  • We are required to do so by law
  • Your account has been inactive for an extended period

12.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Australia.

13.2 Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve any disputes informally by contacting us at support@vetted.com.au. We will work in good faith to resolve the issue.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

14. General Provisions

14.1 Modifications to Terms

We may modify these Terms at any time by posting updated Terms on the Platform. Material changes will be communicated via email or prominent notice on the Platform. Your continued use after such changes constitutes acceptance of the modified Terms.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vetted regarding your use of the Platform.

14.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.4 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.5 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
